Confusing these three aspects \u2013 price, legal certainty and rental potential \u2013 exposes non-resident buyers to avoidable disappointments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Off-plan riad with 1 bedroom and 1 bathroom: definition and legal framework<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before comparing prices, it is important to know exactly what you are buying. A property sold off-plan under the name \u00abriad\u00bb is only of value if the finished product meets specific legal criteria, and is not merely a marketing ploy borrowing terminology from the medina.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Tourist riads: what Moroccan law says<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Act No. 80-14, which has been in force since 4 August 2015, defines the <strong>tourist riad<\/strong> as a house featuring traditional Moroccan architecture and d\u00e9cor, offering accommodation and, incidentally, catering and entertainment. This definition applies in Morocco and determines the establishment\u2019s legal recognition as tourist accommodation, subject to compliance with applicable laws and public order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This classification is not automatic simply on the basis of the building\u2019s architecture. A property may incorporate all the traditional aesthetic features \u2013 a central courtyard, zellige tiles, carved wooden ceilings \u2013 without ever being operated or registered as a tourist accommodation establishment. It is the intended use, rather than the style, that determines the applicable regulations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Off-plan riad vs off-plan standard residential property<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A development marketed as a \u00abriad\u00bb differs from a standard residential property in three ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Architecture and interior design<\/strong>: the riad adheres to traditional Moroccan design principles (patio, local materials, the typical heights and proportions of the medina), whilst a standard residential building often features standardised contemporary architecture.<\/li>\n\n\n\n<li><strong>Desired role<\/strong>: a genuine tourist riad is designed for accommodation, possibly supplemented by catering and entertainment, whereas an off-plan residence is primarily intended for conventional residential use.<\/li>\n\n\n\n<li><strong>Applicable regulatory framework<\/strong>: The operation of a riad as tourist accommodation is governed by Law No. 80-14 and its implementing regulations, a regime distinct from the general law on residential co-ownership.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">There is a legal prerequisite governing all off-plan sales: <strong>It is prohibited to enter into a booking agreement or a preliminary off-plan sale contract before a planning permission has been granted<\/strong>, in accordance with the rules set out by the National Agency for Land Registration, the Land Registry and Cartography (ANCFCC, 2019). A purchaser who is asked to sign before this permit has been issued is, in effect, outside the protective legal framework of the VEFA scheme.<\/p>\n\n\n\n<div class=\"wp-block-group infos is-layout-flow wp-block-group-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Please note<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Buying a property \u2013 even one described as a riad \u2013 does not constitute authorisation to operate a tourist business. For a new opening, the operator must submit a notification of opening, accompanied by a form detailing the standards relating to size, functionality, production and service quality. This procedure applies when the property is operated as a classified establishment, and not when it remains a private residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the cases we handle, the most costly mistake is to include tourist rental income in a financing plan before even having begun the classification process. The purchase of the property and the right to operate it as tourist accommodation remain two legally distinct stages.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Reform of the star rating system from 2025 onwards<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Following the decrees published on 10 June 2025, riads operating as tourist accommodation are now subject to a star-rating system with periodic re-assessment: every seven years for a new establishment, and every five years thereafter. A 24-month transition period has been announced to allow existing operators to bring their businesses into compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a project based on plans, this reform should be incorporated right from the design stage: the target classification level influences the architectural programme (number of toilet facilities, communal areas, fittings) as well as the anticipated running costs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Checks to carry out before signing a VEFA contract for a riad<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ensuring the security of a purchase off-plan involves three checks of the relevant documents, each of which corresponds to a separate legal obligation imposed on the seller.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Check the title deed and service charges<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The preliminary contract must specify the title deed or the property\u2019s reference details, as well as any rights in rem, encumbrances and easements attaching to it, regardless of whether the property is registered or not. This information is essential to ensure a clear understanding of exactly what is being purchased and of any restrictions that may apply to the property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Require the signed terms of reference<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The seller must draw up a set of specifications in accordance with the approved architectural plans, setting out the scope of the project, the services, the fittings and fixtures, as well as the completion and handover dates. A certified true copy, with notarised signatures, must be provided to the purchaser: it is this document, and not the sales brochure, which shall prevail in the event of a dispute regarding the conformity of the delivery.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conditions to be met before the keys are handed over<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The property is only deemed to be completed once the occupation permit or certificate of compliance has been obtained.
